TERMS & CONDITIONS OF SALE, INSTALLATION & USE

1. Company Details

These Terms & Conditions apply to all goods and services supplied by:

2. Definitions

  • Company means SECURED STYLE GATES LTD.
  • Customer means the purchaser of goods and/or services.
  • Goods means gates, posts, automation systems and associated equipment.
  • Works means manufacture, supply, installation, servicing and related services.

3. Bespoke & Made-to-Order Goods (No Refunds)

All Goods supplied by the Company are bespoke and made to order. Accordingly:

  • Orders cannot be cancelled once manufacture has commenced.
  • No refunds are offered for bespoke or custom-made Goods.
  • This is in accordance with the Consumer Contracts Regulations 2013, which exclude custom-made items from cancellation rights.

4. Quotations & Pricing

  • Quotations are valid for 30 days unless stated otherwise.
  • Prices may change if specifications, site conditions or the scope of Works change.
  • All prices are exclusive of VAT unless stated otherwise.

5. Payment Terms

  • Payment terms are as stated on the quotation or invoice.
  • Final payment is due immediately upon completion of the installation unless otherwise agreed in writing.
  • The Company reserves the right to withhold warranty activation until full payment has been received.

6. Installation Acceptance

The Customer shall inspect the installation upon completion and notify the Company of any visible defects, damage or non-conformity before or within 7 days of completion where reasonably possible.

Payment of the final invoice confirms acceptance that the Works have been completed substantially in accordance with the agreed specification. This does not affect the Customer’s statutory rights or the Company’s obligations in respect of genuine warranty defects.

7. Final Payment, Snagging & Return Visits

Final payment is due immediately upon completion of the installation in accordance with the agreed payment terms.

Any non-urgent snagging items, cosmetic touch-ups, customer-requested adjustments, programming changes, replacement of non-defective components, or other return visits will be scheduled once cleared funds have been received.

Where a genuine installation, manufacturing or warranty fault is identified, the Company will rectify the fault within a reasonable timescale in accordance with the applicable warranty. This clause does not affect the Customer’s statutory rights.

8. Ownership, Risk & Repossession (Retention of Title)

  • All Goods remain the property of the Company until paid for in full.
  • Risk transfers to the Customer upon completion of installation.

If payment is not made when due, the Company may:

  • Suspend further works or services; and/or
  • Enter the Customer’s premises at reasonable times with reasonable notice to recover the Goods.

The Customer agrees to provide reasonable access. All repossession costs are payable by the Customer.

9. Design Approval & Specification Tolerances

  • Any approved drawings, designs or specifications are deemed final.
  • The Company accepts no responsibility for aesthetic dissatisfaction after approval.
  • All dimensions, alignments and finishes are subject to reasonable manufacturing and installation tolerances.

10. Site Conditions & Ground Movement

The Company accepts no liability for issues caused by:

  • Ground conditions or subsidence.
  • Drainage issues.
  • Settlement or environmental changes after installation.

11. Electrical Supply Responsibility

  • The Customer must provide a suitable, stable electrical supply.
  • The Company is not liable for faults caused by voltage fluctuation, failure or inadequate supply.

12. Customer Responsibilities

The Customer is responsible for:

  • Ensuring all structures are fit for purpose.
  • Keeping the gate clean and free from obstruction.
  • Using the gate in accordance with instructions.
  • Preventing misuse or unauthorised alterations.

13. Safe Use & Operation

The Company shall not be liable for damage, injury or loss arising from:

  • Misuse or incorrect operation.
  • Failure to maintain or service the gate.
  • Operation contrary to instructions or safety guidance.

14. Vehicle Damage & Gate Misuse

  • The Company accepts no liability for damage caused by misuse, including:
  • Operating the gate during extreme weather.
  • Driving through before the gate is fully open.
  • Stopping within the swing path or sensor area.
  • Tailgating another vehicle.
  • Forcing or bypassing safety systems.

15. Weather Conditions

  • No liability is accepted for damage caused by wind, rain, storms, ice, flooding or unsafe weather-related operation.

16. Third-Party Works

The Company is not responsible for:

  • Adjustments or repairs by third parties.
  • Faults arising from third-party involvement.

17. Call-Outs & Diagnostics

  • If no installation or manufacturing fault is found, call-outs may be chargeable.

18. Software, Apps & Firmware

  • The Company is not responsible for software updates, firmware changes or feature changes by device manufacturers.

19. Complaints Time Limit

Any non-warranty installation concerns or cosmetic issues should be raised within 7 days of completion.

20. Advertising & Branding

The Company may install small branding or name plates. Removal is not included and may be chargeable.

21. Installation Timeframes & Delays

Dates given are estimates only. Delays caused by supply issues, weather, access problems or technical issues do not entitle the Customer to refunds or compensation.

22. Force Majeure

The Company shall not be liable for events outside its control, including weather, strikes, supplier failure or power outages.

23. Limitation of Liability

No liability is accepted for indirect or consequential loss.

Total liability is limited to the contract value.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded or limited.

24. Insurance

The Company maintains appropriate public liability and product liability insurance.

25. Governing Law

These Terms are governed by the laws of England and Wales.

26. Acceptance of Terms

By placing an order, paying any invoice, or permitting the Company to carry out the Works, the Customer confirms acceptance of these Terms & Conditions.
